1. About Us

These Terms & Conditions govern your use of the website www.techup.au and the purchase of products from TechUp Australia Pty Ltd (“TechUp Australia”, “we”, “our”, or “us”).

By accessing our website or placing an order, you agree to be bound by these Terms.

TechUp Australia Pty Ltd operates independently from TechUp New Zealand.


2. Eligibility

By placing an order, you confirm that:

  • You are at least 18 years of age; or

  • You have permission from a parent or legal guardian

  • All information provided is accurate and complete


3. Product Condition & Grading

We sell refurbished and pre-owned devices. Each product listing clearly states its condition (e.g., Premium, Excellent, Good, Acceptable).

Devices may show cosmetic signs of use depending on grade. Cosmetic imperfections do not affect functionality unless stated otherwise.

Images shown may be stock images unless otherwise specified.


4. Pricing & GST

  • All prices are listed in Australian Dollars (AUD).

  • Prices include 10% GST unless stated otherwise.

  • We reserve the right to correct pricing errors.

If a pricing error occurs, we may cancel the order and issue a full refund.


5. Orders & Payment

We accept payment via:

  • Shopify Payments

  • PayPal

Orders are subject to availability and fraud verification checks.

We reserve the right to:

  • Cancel suspicious or fraudulent orders

  • Request additional identity verification

  • Limit quantities per customer


6. Shipping

Orders are shipped via approved courier partners.

Our warehouse address is for courier deliveries and returns only.
It is not open to the public for customer pickup or drop-offs.

Delivery timeframes are estimates only and not guaranteed.

Risk in the goods passes to you upon delivery.


7. Returns & Refunds

Returns are subject to our separate Returns & Refund Policy, available on our website.

You must contact us before returning any item.

Refunds will be processed to the original payment method unless otherwise agreed.


8. Warranty

All eligible devices include a 1-Year Return-to-Base (RTB) Warranty, unless otherwise stated.

The warranty covers manufacturing faults and hardware defects but excludes:

  • Accidental damage

  • Liquid damage

  • Physical damage

  • Unauthorised repairs

  • Normal wear and tear

9. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to:

  • A replacement or refund for a major failure

  • Compensation for any other reasonably foreseeable loss or damage

  • Repair or replacement if goods fail to be of acceptable quality and the failure does not amount to a major failure

Nothing in these Terms excludes your rights under Australian Consumer Law.


10. Limitation of Liability

To the extent permitted by law:

  • We are not liable for indirect, incidental, or consequential losses.

  • Our total liability is limited to the purchase price of the product.

This does not limit rights under Australian Consumer Law.


11. Intellectual Property

All content on this website, including:

  • Logos

  • Images

  • Text

  • Graphics

  • Branding

is the property of TechUp Australia Pty Ltd and may not be copied or reproduced without permission.


12. Account Creation

If you create an account, you are responsible for:

  • Maintaining confidentiality of login details

  • All activities under your account

We reserve the right to suspend or terminate accounts for misuse.


13. Fraud Prevention

We may cancel orders where we reasonably suspect fraud, unauthorised transactions, or policy abuse.

We may request identity verification documentation where necessary.


14. Privacy

Your use of our website is also governed by our Privacy Policy.


15. Amendments

We may update these Terms from time to time. Updated versions will be published on our website.

Continued use of the website constitutes acceptance of updated Terms.


16. Governing Law

These Terms are governed by the laws of Australia.

Any disputes will be subject to the jurisdiction of Australian courts.
