1. About Us

These Terms & Conditions govern your use of www.techup.au and the purchase of products from TechUp Australia Pty Ltd ("TechUp Australia", "we", "our", or "us").

By accessing our website or placing an order, you agree to be bound by these Terms.

TechUp Australia Pty Ltd is a registered Australian company and Licensed Second-Hand Dealer operating in accordance with applicable Australian consumer and commerce regulations.

TechUp Australia Pty Ltd operates independently from TechUp New Zealand.

2. Eligibility

By placing an order, you confirm that:

• You are at least 18 years of age; or

• You have permission from a parent or legal guardian; and

• All information provided is accurate and complete.

3. Product Condition & Grading

We sell pre-owned and refurbished devices. Each product listing clearly states its condition and grading (for example: Premium, Excellent, Good, or Acceptable).

Devices may show cosmetic signs of use depending on their assigned grade. Cosmetic imperfections do not affect functionality unless specifically stated in the product listing.

Product images may be representative images unless otherwise specified.

4. Pricing & GST

All prices are listed in Australian Dollars (AUD).

Prices include 10% GST unless otherwise stated.

We reserve the right to correct pricing errors at any time.

If a pricing error occurs, we may cancel the order and provide a full refund.

5. Orders & Payment

We currently accept payment through:

• Shopify Payments

• PayPal

• Other payment methods displayed at checkout

All orders are subject to product availability and fraud prevention checks.

We reserve the right to:

• Cancel suspicious or fraudulent orders;

• Request additional identity verification; and

• Limit quantities per customer where reasonably necessary.

6. Shipping

Orders are shipped using approved courier and logistics partners.

Our warehouse and dispatch facilities are used exclusively for courier deliveries, dispatch, and approved returns. These facilities are not open to the public for customer pickups or drop-offs unless specifically arranged by us.

Delivery timeframes provided are estimates only and are not guaranteed.

Risk in the goods passes to you upon delivery.

7. Returns & Refunds

Returns are subject to our separate Returns & Refund Policy available on our website.

You must contact us before returning any item.

Approved refunds will be processed to the original payment method unless otherwise agreed.

8. Warranty

Eligible devices include a 1-Year Return-to-Base (RTB) Warranty unless otherwise stated.

The warranty covers manufacturing faults and hardware defects but does not cover:

• Accidental damage

• Liquid damage

• Physical damage

• Unauthorised repairs or modifications

• Normal wear and tear

9. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to:

• A replacement or refund for a major failure;

• Compensation for any other reasonably foreseeable loss or damage; and

• Repair or replacement if goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts, or modifies your rights under Australian Consumer Law.

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, consequential, or special losses; and

• Our total liability is limited to the purchase price paid for the relevant product.

Nothing in this section limits any rights you may have under Australian Consumer Law.

11. Intellectual Property

All content appearing on this website, including but not limited to:

• Logos

• Images

• Text

• Graphics

• Branding

• Website content

remains the property of TechUp Australia Pty Ltd or its licensors and may not be copied, reproduced, distributed, or used without prior written permission.

12. Account Creation

If you create an account with us, you are responsible for:

• Maintaining the confidentiality of your login details; and

• All activities that occur under your account.

We reserve the right to suspend or terminate accounts where misuse, abuse, or fraudulent activity is suspected.

13. Fraud Prevention

We may cancel orders where we reasonably suspect:

• Fraudulent activity;

• Unauthorised transactions;

• Payment abuse; or

• Breaches of our policies.

Where appropriate, we may request identity verification documentation before processing an order.

14. Privacy

Your use of our website is also governed by our Privacy Policy.

15. Amendments

We may update these Terms from time to time.

Updated versions will be published on our website and become effective upon publication.

Continued use of our website constitutes acceptance of any updated Terms.

16. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any disputes arising in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.
